Contact, Detention, and Arrest
Any initial contact between a police officer and a civilian must be consensual unless it's evident a crime has been committed. The reason for this is it's a violation of your rights as a U.S. citizen. Since the officer has not yet gathered enough evidence of guilt of any kind all they can do is merely question you. The officer may try and coerce or manipulate you into talking or saying something that isn't true. Remember in the United States you are innocent until proven guilty and have the right to remain silent. The officer has the right to question you, but, under no circumstances, are you obligated to answer. However, I advise you to be courteous and cooperative with any officer of the law.

After the officer has gathered enough evidence and determined that you committed a crime or were about to, you may be detained. Being detained means the officer now has control and your rights have been temporarily denied. You have not been officially arrested yet, but, the officer has the authority to deny you the ability to leave while he investigates. At this point you still have the right to refuse to answer questions as outlined by the Miranda Rights of the U.S. Constitution, even though you're in police custody. Only when the police has probable cause can you be arrested. If the officer fails to determine there is probable cause for an arrest, he must release you in a reasonable amount of time. If you attempt to leave a detention without the permission of the police officer, you may be subject to arrest and/or physical harm.


Only when an officer determines that there is "probable cause" you committed the crime in question, can an arrest be made. An arrest is non-consensual seizure of an individual by a law enforcement official. The officer does not have to have sufficient evidence to prove your guilt, only that you are likely to be responsible for the crime based on objective evidence. Examples of this are someone identifying you, physical evidence, or an admission or guilt. During an arrest, you're still not required to answer any questions, but you are not free to leave. You will be taken to jail and/or court after you are arrested.
